OPRATS Modifications Needed for 6-5-2024 OPRA Reform Legislation
Description
The new legislation separated out “Commercial purpose”. OPRATS ENHANCEMENT – COMMERCIAL PURPOSE & LEGAL PROCEEDING
A. On the OPRA web portal:

Add “1.” To the current conviction question as such:

Have you been convicted of any indictable offense under the laws of New Jersey or any other state of the United States? (response under penalty of N.J.S.A. 2C:28-3)

Add new “Commercial Purpose certification” as:
-
I, or another person, WILL / WILL NOT use the requested government records for a commercial purpose.
Add new “Legal Proceeding certification” as:

I AM / AM NOT seeking records in connection with a legal proceeding.
If “checked (Yes), a “Identify Proceeding (Case Name, Docket #)” field on form is enabled so Requester can provide information regarding proceeding.
B. Within the Public Records Request Document Set – “Request” Tab:
Utilizing the space under “Due Diligence” add
Convicted of a Crime? w/ check box that is checked when response is “Yes”. Note that may already exists as it was displayed years ago, but was hidden or removed.
Commercial Purpose? w/ check box that is checked when response is “Yes”
Legal Proceeding Related? w/ check box that is checked when response is “Yes”
New text field “Proceeding Info” field.
C. Create Logic that:
When the Requester responds affirmatively that the record request is for commercial purposes, the “Default Due Date” of the “End of Seven Day Clock” task in Activity Tracking” is calculated by adding 14-business days, versus the normal 7-business days, from the date Received.
Generates an automatic email to the Requester that states “as the request is for commercial purposes, the NJDEP has fourteen (14) business days to respond to the request. Additionally, that the Response time frame can be reduced to seven (7) business days upon payment of no more than two times the cost to produce the responsive records. N.J.S.A. 47:1A-5(i)(1).
Status from CGI 2/26/2025 - “Hi Michele. There is some additional testing to be completed in CGI environment, before moving to pre-production which hopefully we can complete by next week.”
Regarding the needed revised web form - Rich Hyjack provided Shane some text txt files that have the new fields in it. He also has the current form ready to go once we get the build.
