Description

1. Describe the origin of this project. The need for this project is driven by what incident(s), pattern of activities or mission goals?DWSG is currently preparing a draft rule proposal for N.J.A.C 7:10 and N.J.A.C. 7:19The purpose is to codify the Water Quality Accountability Act (WQAA), N.J.S.A 58:31-1 et seq. requirements, specifically:• Section 7 of the WQAA requires that Public Water Systems report on its Asset Management Plan (which includes a Capital Investment Report) through a centralized portal every three years (beginning in April 2022)• This Act also requires the submittal of a Certification, which the DWSG would like it to be submitted via the same portal.• The proposal includes requirements for annual Metrics to be submitted, annual water loss audits, annual compliance certifications, and a secure submittal location for Asset Management plans.The centralized portal addresses the WQAA requirement to make the report available simultaneously to the following three different agencies:• Department of Community Affairs (DCA)• Department of Environmental Protection (DEP)• The Board of Public Utilities (BPU)There will be 287 water systems that need to comply with the WQAA.

Project Justification

The WQAA (C.58:31-1) et seq created a statutory mandate for the Department to play a role in the creation of such a portal. https://www.njleg.state.nj.us/2016/Bills/PL17/133_.PDFC.58.:31-7 c) The department, the board, and the Department of Community Affairs shall create a centralized portal allowing for electronic submittal of the report required pursuant to subsection b. of this section
